Criminal Conspiracy, House Trespass and Defamation of Character.

The accused persons (no 1 and 5) conspired and trespassed into the complainant's house that she has bewitched 2 of their daughters. The complainant was dragged from her house and forced to crossover over their daughters in the presence of the community members.

Commissioner of Police Vs Garba Musa

Violence.

The accused called the 10 year old victim (name withheld) to an uncompleted building to abuse her and she refused. The accused then hit her on the face with a bottle causing injury removing one of her tooth. He was brought to court on FIR for causing grievous hurt.

10th march, 2017

The accused was brought to court on FIR and he did not deny the allegation and summary judgement was delivered.

The accused was sentenced to 6 months imprisonment or an option of N10,000 fine and N12,000 compensation for the medical expenses.

This is a success story for FIDA and the case finally settled in favour of the complainant.

Binta Yahaya Vs Ismail Umar

Divorce/Khul’i.

The complainant/victim (19 years old) married to the accused and nursing a baby. The accused does not provide for the mother and child and continually demands sex. If she refuses, she would be beaten up and thrown out in the night. The case was reported to FIDA.

The judge granted the prayer for divorce from the complainant and was asked to return the defendants dowry of N60,000. She just completed the payment and was asked to come and collect the divorce papers on the 29th September 2017.

This is another success story for FIDA as justice has prevailed in favour of the complainant.

Denial of Paternity and Custody.

She has a child with the accused in the IDP camp but the accused denied the paternity of the child.

This is a success story for FIDA even though the case was finally settled out of court. The accused accepted the child and committed to take care of both mother and child.

Custody or Divorce.

The complainant is not happy with the way the husband is treating compared to the co-wives. The accused kept her in a different IDP camp and is staying with the co-wives in another camp with her children. She wants divorce or custody of the children but the husband refused.

The accused agreed not to divorce her and gave her custody of her children.

 

The complainant is currently enjoying the gains of the justice system as she is now in custody of her children.

Defamation of Character and Criminal Intimidation.

The accused told the complainant that her pregnancy is not for her husband and claimed to have witnessed her committing adultery with someone else within the camp. She cursed her that she would suffer with the pregnancy.

Case still pending in court.

Conspiracy and violence.

The accused persons jointly conspired and beat the complainant as a result he sustained injuries. The accused 1 and 2 admitted the charge while 3 and 4 denied the allegation.

 

23rd August 2017.

Summary judgements postponed for accused 1 and 2 and were further detained in prison pending the outcome of the treatment of the complainant.

The accused 3 and 4 that denied the allegation was also detained and the case was adjourned to 28th September 2017 for hearing.

The accused persons are still remanded in prison pending the next hearing.

Hadiza Diri Vs Garba Idris (28 years old)

The accused impregnated the complainant which hid the pregnancy before the parents discovered it at the 8th month. FIDA made her to put to bed before any further action when they received the report. When she put to bed the accused did not deny paternity and he took responsibility.

FIDA organized mediation between the accused and his parents, two (2) elders in the community and two (2) friends of the accused and his elder sister also. He agreed to marry her and the wedding was fixed for 16th September 2017.

This is a success story for FIDA and the parties were happy with the provisions of settlement.

Community Primary/Secondary School Hausari

Community Primary/Secondary School Hausari Vs Garba Ibrahim

The accused (15 years old) took the 12 year old victim to the school toilet and used his finger on her private part. This has happened about five (5) times. The accused threatened the victim not to talk to anybody about it or else he would beat her. The way the victim was walking drew the attention of one of the female teachers who inquired and the victim narrated the whole ordeal. The teacher reported to the principal and the victim was suspended. The father of the accused came to the school the next day, denied the allegation on behalf of the son and threatened the school authorities. The teachers complained to FIDA and NACCRAN protection officer who took up the matter and arranged for the victim to be taken to a specialist hospital.

Upon investigation, it was established that the accused committed the offense and have also molested some other female students. The accused was finally expelled from the school.

The staff of the school as well as the parents was counselled on girl child protection.

This is a success story for FIDA even though the case was settled through mediation but the girl has been seen by the medical professionals and since resumed school. She now knows what to do if such things happens again and can be able to advise her mates too on how to access justice in case of abuse.

Abandoned baby.

A new born baby was found on 19/2/2017 around 6:00am beside Hausari Primary/Secondary School Maiduguri and FIDA was informed via a phone call. FIDA arrived with police officers from the social welfare department. The baby girl was taken to the specialist hospital where it was ascertained that the baby was healthy.

The baby was taken to the motherless babies home Maiduguri and was adopted by the chairperson of WINN (Women in the new Nigeria and Youth Empowerment Initiative) a week later.

This is a success story for FIDA as the case was concluded with the abandoned baby now being adopted into a decent family.

Grema Bashir Vs Adama Ali

Domestic Violence.

The accused stole from their neighbour and the accused children (Ahmed Garba, Baba Karami and Mufida Garba) disclosed that they saw their mother with their neighbour’s property. The mother beat them up and used firewood to burn their mouth.

FIDA filed a complaint at the police station but the accused ran away and mediation was the only option.

This is a success story for FIDA as the case has been resolved. The children are living happily with their uncle, Grema Bashir and FIDA visits them at the end of every month.

Commissioner of Police Vs Hadiza Nasiru

Domestic Violence.

Both parties were married to different people but fight almost every day. On a faithful day, fight ensued between them and Hadiza poured hot porridge on the complainant resulting to burn injuries. The accused then sat on the complainant’s tommy and the complainant was 3 months pregnant.

Mediation was advised for the case as both parties need to be counselled on how to live peacefully as neighbours. Both parties and their families were present at the mediation and the father of the accused catered for the complainants medical bill for treatment and the family of the accused also tendered an apology.

This is a success story for FIDA as both parties are satisfied with the settlement. The result of the scan also revealed that the baby is fine and kicking well.

Girgir Bukar (Mother of 12 year old Baana BG)

Girgir Bukar Vs Arama Dala

Rape.

The accused raped the victim and the mother discovered and reported to FIDA. FIDA reported to the police and the accused was arrested. FIDA wanted to proceed for litigation but the parents of the victim were seriously against it.

 

The victim was taken to the hospital for pregnancy and HIV test which turned out to be negative.

This is a success story for FIDA as all the perpetrators as well as the chemist that assisted the accused to administer the contraceptives; even though the case was settled out of court. The girl is fine and has since resumed her normal life.

Commissioner of police Vs Tijjani Shuaibu

Abduction.

The 15 year old victim had a misunderstanding with the parents and ran away from home. The accused (boyfriend to the victim) abducted her and kept her with him for several weeks and continually have sex with her; even when he knew that the victim’s father was looking for her.

Tijanni was arrested and arraigned through FIR. The parents of the victim gave her out in marriage and the victim was taken to Chad.

The accused was later discharged as the case was overtaken by events.

The 2 accused persons fought and in the process incited public disturbance contrary to section 114 of the penal code. They were arrested and charged to court.

FIDA appeared for the accused persons and pleaded for leniency as they were IDPs. Summary judgement was given and they were cautioned and discharged.

This is a success story for FIDA as both accused were discharged. They also signed a bond to maintain peace within the community.

Adama made a complaint at the FIDA office against the accused (her husband) for beating her and lack of care.

FIDA invited the husband as well as the complainant and other FIDA members. Both parties agreed to live separately without going to court to seek dissolution of marriage.

This is a success story for FIDA as both parties were satisfied with the terms of settlement.

Ahmed Abubakar Vs Suleiman Ya-u

Rape.

The complainant, the father of the victims Aisha Ahmed (8 years old) and Hajara Ahmed (13 years old) reported the accused to Dendel Police Station for raping his two daughters. They entered his keke tricycle and he diverted to a lonely place and raped them.

FIDA followed up on the case and forwarded the case file to CID HQ in Maiduguri for proper investigation while the accused was detained. After proper investigation, the case file was forwarded to the ministry of justice for advice. The case is before the Director of Public Prosecution (DPP) to initiate the charge.  

FIDA is still pursuing the case to ensure that the victims gains access to justice.

Domestic violence.

The complainant is a wife to the accused. The husband is always accusing her of flirting around with other men and also beats her regularly.

This is a success story for FIDA as both were satisfied with the terms of settlement.

The complainant and the accused are IDPs living in the host community. Both parties fought over the distribution card for the relief materials. The accused collected the complainant’s card but refused to return it; when asked for the card, the accused slapped the complainant and fight ensued.

FIDA intervened and the case was filed at the High Court corridor. Both parties were invited and both parties complied with the terms of settlement. The case was disposed on the 13/04/2017.

Both parties were counselled to avoid violence and were satisfied with the terms of settlement.

The complainant entrusted her relief materials to Usman who is the husband of Hauwa. When the complainant went to demand for her relief materials, she found out that they have used it for personal consumption. Fight ensued and accused 1 & 2 beat and injured the complainant.

FIDA intervened and invited both parties at the High Court corridor and both accused agreed to refund the relief materials and see to the medical bills. The all signed to the terms of settlement and the case was disposed on the 16/05/2017.

The accused, who is the husband to the complainant verbally abuses his wife even in the presence of other people and her children. If the complainant responds back, he would take it as an insult and beat her seriously and injured her on the face on this very occasion. She then reported to FIDA.

FIDA invited the accused at the High Court corridor in Maiduguri and he admitted that he had made a mistake and promised that it would not repeat itself again. The case was disposed on 15/04/2017.

After hearing, the complainant stated that she loves her husband and just wants the case to be settled. Since then, no complain has been received from the complainant with respect to any form of domestic violence.

The complainant levelled a claim against the accused, her husband that whenever she had a misunderstanding with her co-wife, the husband use to beat her up and blame her for the wrong she never committed.

FIDA invited the accused through a letter emanating from the High Court corridor summoning the husband to attend the ADR sitting. The husband admitted to committing the act and FIDA explained the consequences of such acts and he promised not to violate the complainant ever again.

The case was disposed on the 08/03/2017 and since then no further complaints have been received from the complainant.

Sexual Exploitation.

The complainant complained of sexual exploitation by the accused that impregnated her and refused to take care of her and the child. The accused went further to deny the paternity of the child.

 

Both parties and FIDA officials attended the session of the settlement. The accused later agreed that the child belongs to him and also agreed to be paying a certain sum to the mother every month for their upkeep.

The case was disposed on 28/08/2017.

The accused was charged to court. The accused was remanded in prison and later grated bail based on formal application before the court.

The case is coming up on the 27/09/2017 for the prosecution to open the case.

Cheating.

The complainant levelled a complaint against the accused, his fellow IDP. He gave him his NEMA/SEMA card to help him follow a queue for relief materials but to his dismay, the accused used the card and collected food items without informing him. When it was his turn, the officials rejected him and sent him away.

Both parties were called and mediation was organized. They came with witnesses and testified on 22/04/2017. The accused was found guilty of the offence and was asked to return the food items which he has done.

The case was settled and the complainant was satisfied with the terms of settlement.

Violence

The parties are IDPs from Gubio IDP Camp. Both accused gathered and beat up the complainant over food distribution in the camp. The attention of FIDA was drawn.

FIDA called both parties and their witnesses. Both accused persons agreed to have committed the offence. Both accused apologized. They said they acted out of provocation and have now realized their mistake.

This is a success story for FIDA and the parties now understand the implication of their action.

Both parties were invited for mediation and they agreed to what transpired between them. They were counselled and both agreed not to engage in fighting again and promised to maintain peace. Both agreed to stay in separate places to conduct their trade.

Refusal to pay wards exam fees.

The complainant is  a student though fathered by the accused but stays with her maternal aunt. The accused works with a security agency. The complainant’s aunt paid her WAEC fees but the accused refused to pay the NECO fees as agreed. The matter was reported to FIDA.

The parties were invited for mediation. The accused complained because FIDA demanded for his statement of account. The accused family intervened and brought the registration fee the next day.

It was a success story for FIDA as the complainant wrote her exams without any hitches. The case was disposed on 28/08/2017. The accused understood the consequences of his actions.

Attempt to Abuse.

The complainant noticed some weird behaviour with the accused. The accused used to come to her tent often in the IDP camp and was ignorant of the motive behind the regular visit. One day, she caught the accused removing her 3 year old daughter’s pant. She screamed and people gathered. He was beaten by the people in the camp and the report got to FIDA.

Mediation was arranged by FIDA. After hearings and counselling sessions, the accused apologized and the complainant forgave him. He was marked and kept under close watch by the people in the camp.

The complainant was satisfied with the outcome of the mediation and gained knowledge of actions to take in event of any abuse.

Stealing.

All the parties are residents of Teachers Village IDP camp and neighbours as well. The complainant’s NEMA/SEMA card for collection of food items was stolen and it hindered him from getting food items for 3 months. The complainant later discovered the card with the accused persons and reported to FIDA.

FIDA invited the parties for mediation. The accused persons admitted to stealing the card and using it for their own gain. The card was returned to the complainant and an agreement was drafted that the accused persons would be giving him some food items for 2 months.

This is a success story for FIDA as the complainant was satisfied with the justice levelled in his favour.

This is a case of rivalry, jealousy and envy.

The accused person (Falmata Umar) maltreated and tortured Umaimah Umar (9 year old girl) who is her step daughter and under her care. She used a long spoon that was heated in fire on the girl's body and she sustained injury as a result. Complainant called FIDA on phone after taking the matter to human right commission.

FIDA filed a formal complaint to the police; FIR was drafted and sent us to the court. The FIR was read and the accused said the allegation was true. Justice was granted to the complainant as the accused was sentenced to 12 months imprisonment or Ten thousand naira fine.

FIDA stood for the victim through the complainant and the accused was finally convicted. The complainant gained access to justice as desired.
